MINOR PORTRAIT CONTRACT & RELEASE

For valuable consideration, I hereby confer on Chris Pingel; Pingel's Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of my minor child in which he/she may be included with others:

a) To copyright the same in Chris Pingel; Pingel's Photography name or any other name that he/she may select; Until final payment for services rendered is made all photographs produced by Pingel's Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without explicitly written permission from Pingel's Photography. Upon final payment by the Client limited copyright ownership of the resulting images is allowed to the Client under the following conditions:

· The film and / or prints are the property of Client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives.

· Images may be used on personal web sites as long as a copyright notice appears near or on the images stating that they were taken by Pingel's Photography or a web link to http://www.pingelsphotography.com is placed onto the web site.

· The Client must obtain written permission from and compensate Pingel's Photography prior to the Client or its friends and relatives publishing or selling the photographs for profit.

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

c) To use my name or my child’s name or a fictitious name in connection therewith if he/she so decides. I hereby release and discharge Chris Pingel; Pingel's Photography from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. This authorization and release shall inure to the benefit of the legal representatives, licensees and assigns of photographer Chris Pingel; Pingel's Photography as well as the person(s) for whom he/she took the photographs. I have read the foregoing and fully understand the contents hereof. I represent that I am the [parent/guardian] of the above named model. For value received, I hereby consent to the foregoing on his/her behalf.
